Consumer Rights, Delivery, Return and Cancellation Policy
If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
You can benefit from online single payment or online installment opportunities with your credit cards through our website. In your online payments, the amount will be deducted from your credit card at the end of your order.
The CONSUMER is subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other laws in force regarding the sale and delivery of the product purchased.
Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the CONSUMER may terminate the contract.
If the sale of the purchased product becomes impossible, the SELLER must notify the Buyer in writing within 3 days of learning about this situation. The total price must be returned to the CONSUMER within 14 days.
If the CONSUMER does not pay the price of the product he/she purchased or cancels it in his/her bank records, the SELLER's obligation to deliver the product ends.
If, after the product is delivered, it is determined that the credit card used by the consumer for payment has been used unfairly by unauthorized persons and the price of the product sold is not paid to the SELLER by the relevant bank or financial institution, the Consumer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs being borne by the SELLER.
If force majeure reasons that cannot be foreseen by the SELLER occur and the product cannot be delivered on time, the situation will be notified to the CONSUMER. The CONSUMER may request the cancellation of the order, replacement of the product with a similar one or postponement of delivery until the obstacle is eliminated. If the CONSUMER cancels the order; if the payment was made in cash, this fee will be paid to the CONSUMER in cash within 14 days from the cancellation. If the CONSUMER made the payment by credit card and cancels, the product fee will be returned to the bank within 14 days from the cancellation, but the bank is likely to transfer the amount to the CONSUMER's account within 2-3 weeks.
The CONSUMER shall inspect the goods/services subject to the contract before receiving them; shall not accept damaged and defective goods/services such as crushed, broken, torn packaging, etc. from the cargo company. The goods/services received shall be deemed to be undamaged and intact. The CONSUMER shall protect the goods/services carefully after delivery. If the right of withdrawal is to be exercised, the goods/services shall not be used.
In distance contracts related to the sale of goods, the CONSUMER has the right to reject the goods and withdraw from the contract within 14 (fourteen) days from the date of receipt without assuming any legal or criminal liability and without giving any reason. In distance contracts related to the provision of services, this period begins on the date the contract is signed. If it is agreed in the contract that the service will be performed before the 7-day period expires, the CONSUMER can exercise the right of withdrawal until the date the performance will begin.
If the CONSUMER exercises his/her right of withdrawal, he/she must return the purchased product to the SELLER via MNG CARGO, a contracted company of the SELLER. If the returned product is sent via a contracted cargo company, the expenses arising from the use of the right of withdrawal will be borne by the CONSUMER. If the product is sent back to a cargo company other than the contracted cargo company of the SELLER in the use of the right of withdrawal, the return shipment cargo expenses will be covered by the CONSUMER.
In order to exercise the right of withdrawal, it is required that the SELLER be notified within 7 days to the e-mail address info@umaypharma.com provided above and that the product has not been used within the framework of the provisions of Article 15 titled “Exceptions to the Right of Withdrawal” of the Distance Contracts Regulation published in the Official Gazette on 27/11/2014 and Article 6 of the Distance Sales Contract signed electronically between the Parties. The return procedures within the scope of the Right of Withdrawal are also included in the Distance Sales Contract in detail.
After the return request is approved by UMAY İLAÇ SAN ve TİC AŞ via e-mail, the CONSUMER is obliged to return the goods to the SELLER within 10 (Ten) days from the date the notification of the right of withdrawal reaches the SELLER through the MNG KARGO company with which the SELLER has a contract. If the consumer does not send the goods back to the SELLER within 10 (Ten) days from the date the notification of exercising the right of withdrawal is sent to the SELLER, the withdrawal request will be deemed invalid. If your return request is not approved, you will be informed and if the product has been sent to us for return, it will be sent back to your address with payment against payment.
If the amount falls below the campaign limit set by the SELLER due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.
Due to their nature; single-use products, copyable software and programs, products that deteriorate quickly or have an expiration date are not accepted for return. Unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the following contracts;
i. Contracts for goods or services whose prices vary depending on fluctuations in financial markets and are not under the control of the seller or provider.
ii. Contracts regarding goods prepared in line with the consumer's wishes or personal needs.
iii. Contracts for the delivery of goods that are perishable or subject to expiry.
iv. Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; and whose return is not suitable for health and hygiene reasons.
v. Contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature.
vi. Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package are opened after delivery of the goods.
vii. Contracts for the delivery of periodicals such as newspapers and magazines, other than those provided under subscription contracts.
viii. Products that are custom-made with a name or logo printed on them and fountain pens with cartridges attached or ink filled cannot be returned. Promotional or campaign products given as gifts must also be returned at the same time as the product to be returned. The return of a gift product can only be done when it is sent together with the main product.
In order for purchased products to be returned within the scope of the "Right of Withdrawal", the purchased product must be sent complete and undamaged with its original box, packaging and standard accessories, together with its original invoice (the invoice of the product delivered to the 3rd party or the BUYER, if the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution when returning. Returns of orders whose invoices are issued in the name of institutions cannot be completed unless a RETURN INVOICE is issued.) via MNG Cargo. If not sent, the return request will be rejected.
It is sufficient to package your returned products in a way that they will not be damaged in cargo and send them to Umay İlaç San ve Tic AŞ through our contracted cargo companies. If products that are not packaged properly are damaged in cargo, your shipments will not be received from the cargo company.
After checking the compliance of the product with the return conditions, the refund will be processed to your card. Depending on your bank, it may take a few days for your payment to be reflected in your account. Your refund will be made in the same way you made your payment. In installment payments, refunds are made by banks in installments.
